[버뱅크=민족통신 손세영 편집위원]19일 오전9시 버뱅크시 고등법원 2호실에서 마가레트 올덴도르프 판사 주재로 열린 예비재판(Pre-trial)에는 민족통신 대표를 죽인다고 협박하여 경찰에 기소되었던 윤병열 피고인과 그의 변호인 민병수 변호사가 참석했고, 피해자 노길남 민족통신 편집인겸 대표를 대신해서는 버뱅크 시검사실의 디아나 추옹 검사가 배석했다.

이날 예비재판에서 추옹 검사는 윤병열 피고인이 대학동문회 임원들을 통해 피해자인 노길남씨에게 접근하여 재판을 포기하라는 등 간접적으로 압력을 가했다고 지적하며 직접이든 간접적이든 일체 접근하지 말것을 명령(Stay-Away Order)하면서 전화, 인맥, 인터네트 등을 통해서도 접근하지 못하도록 설명하면서 이것을 어길경우 중벌이 내려 질 것이라고 경고하기도 했다. 한편 피고인을 대신하여 법정에 선 민병수(미국이름 윌리엄)변호사는 지난 5월9일 로스엔젤레스 수피리얼 법원에서도 윤병열 피고인에게 접근명령을 내린 것으로 알고 있는데 버뱅크 법정에서 또 접근명령을 내릴 필요가 있겠느냐고 항의하자, 이에 대해 추옹 검사는 동창회 등 제3자를 통한 접근도 되어서는 안된다고 주장하자 판사는 검사측의 주장을 받아 들여 제3자 접근도 금지시키는 명령을 내렸다. 판사는 즉시 윤별열 피고인을 향해 제3자 접근을 포함하여 전화, 인터네트 등 일체 피해자에게 접근하지 말것을 명량한다고 말하고 이에 대해 피고인의 의견을 묻자 "따르겠다"고 답변하여 접근금지명령 서류를 즉석에서 받았다. 피고측 변호사는 이날 재판일정에 대해 몇가지 이유를 제시하며 오는 7월7일로 정했으면 좋겠다고 제언하자 판사는 이를 받아 들여 2011년 7월7일 재판이 열린다고 확정했다.
이 재판은 민족통신 대표인 노길남 박사가 근 6개월 가까이 한 괴한의 협박전화로 시달려 오다가 경찰에 고발하여 2개원 만에 범인을 추적하여 버뱅크 경찰이 기소하여 시검사실에 넘긴 사건으로 진행되고 있다.

For many years, ANSWER has known and worked with Mr. Ken Kilnam Roh and Minjok, the international Korean media outlet for which he writes. We believe that Mr. Roh’s work at Minjok-Tongshin(www.minjok.com) is extremely important journalism. It is compassionate; it is of the highest integrity. In addition, Mr. Roh’s work is, and always has been, protected by the First Amendment—a cornerstone to for the free press in the United States. This is why ANSWER is extremely dismayed to know that someone in the Korean American community, Byung Yul Yoon, has made the most insidious, hateful threats to Mr. Roh’s life and livelihood. Mr. Yoon left hundreds of harassing and threatening voice mail messages on Mr. Roh’s cell phone, apparently because he did not like an article posted by Minjok. In those messages, Mr. Yoon threatened to “gouge” Mr. Roh’s eyeballs out “with a knife” and to “kill” Mr. Roh and his family, along with other horrific things. In a democratic society, these types of threats against journalists—or anyone—cannot stand. They must be stopped and punished to the fullest extent. Championing press freedom means standing against threats and intimidation aimed at journalists. Mr. Roh has the absolute right to write about Korea and Korean politics, including the desire of the Korean people for reunification and peace. ANSWER believes that Mr. Yoon should face justice, including time in jail for his horrific death threats directed at Mr. Roh. Should Mr. Yoon plead or be found guilty, we believe he should be given the maximum sentence permitted under the law and ordered to stay away from Mr. Roh. As a pastor of Westmont United Methodist Church and a chairperson of Pan-Korean Alliance for Reunification of Korea in the United States of America, I have a great concern about this case, because it happened in the Korean-American community in the great Los Angeles area, which is relatively newly forming community in the USA. I believe that the judicial decision of this case is very important, because it will effect not only to form the great, strong, respected and happy community here in the great Los Angeles Area, but also other Korean-American communities in the United States of America. One of the great strength of the United States is the system of the USA government based by the freedom of the speech and the press that is provided by “the Bill of Rights” and the “Declaration of Independence of the United States of America.” Whoever they are we or our ancestors are all immigrants or descendents of the immigrant who came to the USA to pursuit of happiness in the free society. However, Mr. Roh and his families’ life were bothered and threatened severely by Mr. Yoon who hated Mr. Roh’s work. Mr. Yoon didn’t respect his right to believe and to act for justice for all. Mr. Ken Roh is a well-educated person in here in the United States of America as well as in South Korea. For 10 years up to 2010, I worked with Mr. Ken Kilnam Roh and Minjok, the international Korean media outlet for which he writes. Minjok-Tongshin is a very important journal for working to realize the justice for all. He worked sacrificially for the journal and for the local and for international community to pursue the justice for all. I believe that Mr. Yoon should face justice, including time in jail for his horrific death threats directed at Mr. Roh. I believe that this is the case to reveal and educate people of the greatness of the judicial system and how important it is to live lawfully and respectfully as a citizen of the U.S.A. Mr.Roh is a respected journalist and a friend and supporter of the organized peace movement in Los Angeles. For more than 15 years, many organizations have relied on him for important news regarding the Korean Peninsula and the issue of its division since 1950-1953 Korean War. His diligent work results in radio shows, newspaper articles and web based reports with information that is simply not available in the mainstream media. Beyond that, he has been and remains a consistent supporter of peace, generous with his time and his voice. When the peace movement was at it’s peak in response to the Bush administration’s moves to go to war against Iraq in 2003, we organized some 17 million people around the world, including more than100,000 in Los Angeles to demonstrate for Peace. Mr. Roh was one of the heroic volunteers. He sat through the endless organizing meetings, dug in his pocket to contribute, marched with the rest of us, carried the signs, and raised his voice. That an individual could threaten Mr. Roh and his family with words of violence, and cause his grandchild to fear for his safety, is a personal affront for those of us who know him as a friend and supporter. Even more important is the erosion of our societal right to receive objective news, and our individual rights to hold and express an opinion on any issue-without fear of reprisal. If Mr. Roh is being threatened with violence, then in a very real sense, we are all being threatened with violence. We call on all appropriate institutions to take this matter seriously, and to assure the safety of Mr. Roh and his family. I have known Mr. Kilnam Roh for a number of years. As a journalist, he has often covered KIWA’s press conference and other activities. He has always been cordial and professional in his dealing with KIWA. It has com to my attention that Mr.Roh has been harassed, stalked, and threatened by Mr.Byung Yul Yoon. I understand that Mr. Yoon has even made death threats against Mr.Roh. Stalking and threats of violence should be taken seriously and not be tolerated for any reason. It is especially disturbing that Mr. Yoon apparently undertook theses activities because he disagreed with Mr.Roh’s political views. Whatever the motivation, if Mr. Yoon has broken any laws, we urge that violations be addressed without delay and that appropriate measures be taken for Mr. Roh’s physical safety.
